USER AGREEMENT

Section 1. Terms and Definitions

1.1. The "Platon" Automated Information System (hereinafter — the "System") is a software and hardware complex combining electronic document management tools, educational process management and tools for interaction between participants of the higher and (or) postgraduate education process.

1.3. Educational organization (Educational institution) — a higher education institution or another educational organization using the System to organize and support the educational process.

1.4. User — an individual who has a registered Personal Account in the System.

1.5. Personal Account — the User's account containing information about them and the set of authorized access rights to the System's Services.

1.6. Password — a sequence of characters known only to the User, stored in the System in encrypted form and used together with the username for authentication.

1.7. Services (paid and free) — products and services provided to the User within the framework of the System's operation in accordance with this Agreement. The procedure and conditions for providing paid Services (if any) are determined by a separate agreement on the provision of paid services and (or) by separate agreements for a specific service.

1.8. Administrator — a staff member of the educational organization who has the authority to administer Personal Accounts and to enter (edit) information in the System.

1.9. Agreement — this text of the User Agreement and its appendices, containing the essential terms for granting access to the System, the terms of use of the System and its main Services, the procedure for restricting, suspending and terminating use of the System, the liability of the parties, as well as other relations of the Parties related to the use of the System. Compliance with the terms of this Agreement is a mandatory condition for using the System and receiving its main Services.

Section 2. General Provisions

2.1. This Agreement is a contract of adhesion in accordance with Article 389 of the Civil Code of the Republic of Kazakhstan and governs the terms of use of the System. The Agreement applies to the User from the moment of logging into the System, creating a Personal Account, entering a username and a temporary password, and also upon further access by the User to the System using a username and password. Clicking the "Register" button, as well as the commencement of use of the System, means the User's full and unconditional agreement with this Agreement (acceptance of the offer) in accordance with Article 396 of the Civil Code of the Republic of Kazakhstan. In case of disagreement with the terms of the Agreement, the User undertakes not to begin using the System and (or) to stop viewing or using the System's Services, and also to delete any materials posted by them in the System.

2.2. By agreeing to use the System, the User consents to receiving information about updates, offers and announcements posted in the System.

2.3. The User independently monitors changes to the Agreement and familiarizes themselves with its current version. Continued use of the System after amendments and (or) additions to this Agreement means the User's acceptance of and agreement with such amendments and (or) additions.

2.4. The provision to the User of paid Services, in particular additional functional capabilities of the System provided at the User's request on a paid basis, is governed by a separate agreement.

Section 3. Rules for Logging into the System

3.1. Registration of a Personal Account in the System is carried out using account credentials established by the settings of the educational organization.

3.2. If inaccurate or incorrect data is found in the Personal Account, the User has the right to contact the educational organization to have it corrected.

3.3. If a temporary password is used during registration, the User must replace it with a permanent one upon first login to the System. In the event of a lost password, it is restored through the password recovery procedure provided by the System.

3.4. Login to the System is carried out through the User's authorized access to the client part of the System (web interface) via the Internet. Login to the System via the mobile application is governed by a separate agreement. The User bears full responsibility for the security of their username and password, in particular for preventing access to them by third parties. All actions performed in the System using the User's Personal Account are deemed to have been performed by the User themselves unless proven otherwise.

3.5. The User undertakes to use the System in accordance with its intended purpose.

3.6. The User's access may be terminated by the Administrator in cases where the grounds for using the System cease to exist, or in other cases provided for by the legislation of the Republic of Kazakhstan and the internal acts of the educational organization.

3.7. Deletion of the User's Personal Account from the System is carried out by the Administrator when there are grounds for deletion provided for by the Agreement and the internal documents of the educational organization.

3.8. Claims, requests and inquiries related to the use of the System may be sent by the User to the educational organization.

Section 4. Rules of Interaction between the Administration and the User

4.1. The Administration undertakes to provide Users with round-the-clock access to the System's Services via the Internet for entering and viewing information necessary to support the educational process, taking into account the required level of security and possible interruptions for technical maintenance. The Administration has the right to engage third parties to provide any Services without notifying or obtaining the consent of the User.

4.2. The Administration is not liable for direct or indirect financial or other losses of Users arising from the temporary inoperability of the System, including as a result of planned or unplanned technical and preventive maintenance work, technical failures of internet providers, computer networks, servers and equipment, as well as as a result of intentional or negligent actions of third parties, actions of the User themselves, and (or) force majeure circumstances. At the same time, the Administration undertakes to restore the System's operability as soon as possible.

4.3. The Administration is not liable under any circumstances for the infringement of the intellectual property rights of third parties if such infringement is related to the creation, uploading, posting, copying or modification of information, materials or images produced by Users of the System.

4.4. The User agrees that personal data is processed for the purposes of registration, identification, authentication and authorization of Users, granting access to the System and its Services, ensuring their operation, implementing the functional capabilities of the System, organizing and supporting processes carried out through the System, fulfilling contractual and other obligations, ensuring interaction between participants of the System, providing technical and informational support, ensuring information security, complying with the requirements of the legislation of the Republic of Kazakhstan, and for achieving other legitimate purposes related to the operation of the System and the provision of relevant services to Users, including for the purposes of analyzing, improving and developing services, processes and functional capabilities.

4.5. In cases provided for by the legislation of the Republic of Kazakhstan, the Administration has the right to independently process certain categories of personal data as a personal data operator.

4.6. In cases provided for by the legislation of the Republic of Kazakhstan, consent to the collection and processing of the personal data of a minor, incapacitated or partially capable User is provided by their parent, adoptive parent, guardian, custodian or other legal representative in the manner established by the legislation of the Republic of Kazakhstan.

4.7. The processing of personal data of minor, incapacitated and partially capable Users is carried out in compliance with the requirements of the legislation of the Republic of Kazakhstan in the field of personal data, education and other regulatory legal acts of the Republic of Kazakhstan.

4.8. When the User uses Services provided through the System or the mobile application, including the services of banks, financial organizations and other organizations, the User agrees to the transfer by the Administration of the necessary personal data to the relevant organizations to the extent necessary to provide the requested service, in accordance with the legislation of the Republic of Kazakhstan.

4.9. The Administration processes the User's personal data from the moment the data is entered into the Personal Account and for the period established by the legislation of the Republic of Kazakhstan.

4.10. The User undertakes not to disclose, verbally, in writing or by any other means, their username, password and other System access credentials to other persons. The Administration is not liable for the loss or damage of data resulting from authorized access to the System by third parties using the User's username and password.

Section 5. Rules for Posting Information Protected by Intellectual Property Legislation

5.1. All materials presented in the System, including images, program code, logos, tables, audio files, and educational and methodological materials, are objects of copyright or related rights of their rightholders and are protected by the legislation of the Republic of Kazakhstan in the field of intellectual property.

5.2. When using the System, it is prohibited to upload, transfer between Users, modify or post information, data or images that infringe the exclusive rights of third parties, including copyright and related rights, as well as rights to inventions, utility models, industrial designs or trademarks.

5.3. The User is liable for infringement of the rights to the results of intellectual activity and means of individualization of third parties, in particular copyright and related rights, as well as exclusive rights to inventions, utility models, industrial designs or a trademark.

5.4. In the sections of the System, the User has the right to publish only comments (including profile images, message texts and attached photographs) that do not violate applicable legislation and (or) the rights of third parties.

5.5. The Administration reserves the right to block any information posted by the User that infringes the intellectual and (or) exclusive rights of third parties, including copyright and related rights, at the request of the rightholder or without such a request.

Section 6. Prohibited Use of the System

The User is prohibited from:

6.1. Uploading, posting, transmitting through the System's software tools or otherwise publishing texts, programs, images or materials that promote terrorist activity or incite ethnic, racial or religious hatred, as well as depicting or promoting violence or death, containing pornography in any form, a description or depiction of actions causing harm to minors, or other information inciting unlawful actions in any form.

6.2. Uploading, storing, using or transmitting descriptions of fraudulent schemes, multi-level marketing (MLM) schemes, or schemes for generating income on the Internet.

6.3. Impersonating another person, organization or representative of a community, as well as misleading other Users.

6.4. Collecting and storing outside the System, manually or in an automated manner, the data of other Users.

6.5. Creating, distributing or using in any way computer programs or other computer information intended for the unauthorized destruction, blocking, modification, or copying of computer information, neutralizing computer information protection tools, as well as for disrupting, destroying or limiting the functionality of any computer or telecommunications equipment or programs (computer viruses), for gaining unauthorized access to the System's paid Services, and posting links to such information.

6.6. By using the System, the User undertakes not to violate the information security of the System, in particular not to:

Section 7. Liability for Violation of Academic Integrity and Content Moderation

7.1. The Administration has the right to moderate all materials posted by Users in the System, i.e., to monitor the content and quality of such materials, and, if necessary, at its own discretion, without warning or explanation of reasons, to remove or relocate them in accordance with the System's internal moderation regulations. The Administration is not liable for any consequences of actions taken as part of the moderation procedure.

7.2. The use of the System to commit actions that violate the principles of academic integrity (in particular, posting other people's academic work under one's own name, falsifying learning outcomes) is governed by the internal acts of the educational organization and is not the responsibility of the System's Administration.

Section 8. Final Provisions

8.1. The Administration reserves the right to immediately take measures against a User who has violated Sections 5 and 6 of this Agreement, without prior notice to the educational organization. In addition, in the event of a User's violation of this Agreement, the Administration undertakes to assist representatives of law enforcement agencies in collecting and providing information about the User who has violated this Agreement and (or) the legislation of the Republic of Kazakhstan, in the cases and in the manner provided for by the legislation of the Republic of Kazakhstan.

8.2. Depending on the nature of the materials or the characteristics of individual Services of the System, the Administration has the right to introduce special conditions for registration and access to such materials and Services, including age and other restrictions.

8.3. The relations of the Parties under this Agreement are governed by the legislation of the Republic of Kazakhstan.
